Assisted Probate Service

The death of a family member is a traumatic event for your family and can leave those entrusted to carry out the deceased’s wishes feeling overwhelmed, not knowing which way to turn for help, but at the same time wishing to do their best in memory of a loved one and for those who are left behind.

The Assisted Probate Service has been developed to provide Executors with a cost effective approach to Probate and the administration of the estate.  By only engaging a Probate Specialist to carry out the more technical aspects of the process there is potential to save money whilst, at the same time, having the peace of mind that the requirements for Probate and the associated HMRC disclosures have been fully met and all available allowances have been applied for.

The Probate process can be condensed into 7 stages.

  1. Registration of the death and obtaining the Death Certificate.
  2. The completion of a final income tax return.
  3. Identifying and valuing the estate.
  4. Completing the appropriate HMRC forms and paying any inheritance tax due.
  5. Making an application to the Probate Registry for the Grant of Representation.
  6. Collection and distribution of the estate.*
  7. The fulfilment of protective trusts such as Nil Rate Band Trusts and life interest trusts.

*The collection and distribution of the estate is a key advice stage and covers the effective transfer or sale of properties and Land Registry as well as advice on investments. e.g. ISAs.

We will guide you through the process, supporting you every step of the way, to ensure this often problematic process is completed as smoothly and efficiently as possible.  We will also advise on potential planning in order to take advantage of available tax allowances and protection planning.

In our opinion, every pound saved in Probate fees is an additional pound passed onto the family and surely that’s a good thing.
